The purpose of this essay is to advocate for including jurilinguistics in legal education. It presents jurilinguistics as a tool for understanding law and therefore supports continuing efforts to teach it. Knowing it is not unique, this essay proposes a jurilinguistic approach that focuses on the in-between of legal translation and comparative law. The proposal outlines the importance of educating in the capabilities of teaching a particular subject in a language other than their official one. The idea is to let (...) the Other help to understand the Self. Particularly pertinent in transnational law programs, it is a multicultural approach that not only recognizes the other, but also embraces it. (shrink)

The paper argues that the formulation of quantum mechanics proposed by Ghirardi, Rimini and Weber (GRW) is a serious candidate for being a fundamental physical theory and explores its ontological commitments from this perspective. In particular, we propose to conceive of spatial superpositions of non-massless microsystems as dispositions or powers, more precisely propensities, to generate spontaneous localizations. We set out five reasons for this view, namely that (1) it provides for a clear sense in which quantum systems in entangled states (...) possess properties even in the absence of definite values; (2) it vindicates objective, single-case probabilities; (3) it yields a clear transition from quantum to classical properties; (4) it enables to draw a clear distinction between purely mathematical and physical structures, and (5) it grounds the arrow of time in the time-irreversible manifestation of the propensities to localize. In the first part of the paper I argue that an ontology of events is precise, flexible and general enough so as to cover the three main alternative formulations of quantum mechanics as well as theories advocating an antirealistic view of the wave function. Since these formulations advocate a primitive ontology of entities living in four-dimensional spacetime, they are good candidates to connect that quantum image with the manifest image of the world. However, to the extent that some form of (...) realism about the wave function is also necessary, one needs to endorse also the idea that the wave function refers to some kind of power. In the second part, I discuss some difficulties raised by the recent proposal that in Bohmian mechanics this power is holistically possessed by all the particles in the universe. (shrink)

In the literature on the compatibility between the time of our experience and the time of physics, the special theory of relativity has enjoyed central stage. By bringing into the discussion the general theory of relativity, I suggest a new analysis of the misunderstood notion of becoming, developed from hints in Gödel's published and unpublished arguments for the ideality of time. I claim that recent endorsements of such arguments, based on Gödel's own ‘rotating’ solution to Einstein's field equation, fail: once (...) understood in the right way, becoming can be shown to be both mind-independent and compatible with spacetime physics. Being a neededtertium quidbetween views of time traditionally regarded as in conflict, such a new approach to becoming should also help to dissolve a crucial aspect of the century-old debate between the so-called A and B theories of time. In this paper I review three different positions on the wave function, namely: nomological realism, dispositionalism, and configuration space realism by regarding as essential their capacity to account for the world of our experience. I conclude that the first two positions are committed to regard the wave function as an abstract entity. The third position will be shown to be a merely speculative attempt to derive a primitive ontology from a reified mathematical space. Without entering any discussion about nominalism, I (...) conclude that an elimination of abstract entities from one’s ontology commits one to instrumentalism about the wave function, a position that therefore is not as unmotivated as it has seemed to be to many philosophers. We discuss the three dominant models of the phenomenological literature pertaining to temporal consciousness, namely the cinematic, the retentional, and the extensional model. This is first done by presenting the distinction between acts and contents of consciousness and the assumptions underlying the different models concerning both the extendedness and duration of these two components. Secondly, we elaborate on the consequences related to whether a perspective of direct or indirect realism about temporal perceptions is assumed. Finally, we review some relevant findings (...) from the psychology and neuroscience of temporality in order to decide which of the three models of time consciousness is better confirmed from an empirical viewpoint. Depending on the time scale, all three models of temporal consciousness might apply. We specifically argue in favor of an extensional model of time consciousness for the experienced present where the acts and contents of consciousness are both extended. The retentional model might apply to longer time intervals covered by working memory. In addition, a predictive component is highlighted as decisive for an understanding of temporality. (shrink)

After a brief presentation of Feynman diagrams, we criticizise the idea that Feynman diagrams can be considered to be pictures or depictions of actual physical processes. We then show that the best interpretation of the role they play in quantum field theory and quantum electrodynamics is captured by Hughes' Denotation, Deduction and Interpretation theory of models, where “models” are to be interpreted as inferential, non-representational devices constructed in given social contexts by the community of physicists.

In the dispute between presentism and eternalism, the affective dimensions of the debate have been somewhat neglected. Contemporary philosophers of time have not tried to relate these ontological positions with two of the most discussed maxims in the history of ethics – “live in the present” vs. “look at your life under the aspect of the eternity” (sub specie aeternitatis)– that since the Hellenistic times have been regarded as strictly connected with them. Consequently, I raise the question of whether the (...) endorsement of one of these two ontological views can make a practical difference in the way we should live. -/- . (shrink)

In this paper we critically review Correia’s and Rosenkranz’s Nothing to Come. A Defence of the Growing Block Theory of Time, published by Springer in 2018. By taking into account the essential reliance of the book on tense logic, we bring out the existence of a conflict between their logical axioms, that presuppose truth bivalence even for statements concerning future contingents, and the principle of groundedness that they also advocate. According to this principle, a proposition Q is now groundedly true (...) as long as sometimes in the future it will be the case that there exists something that makes Q true. However, if the events that occur in 2060 do not exist unrestrictedly (for us, here in 2021), what, in reality, can possibly ground the truth (or falsity) of Q? In the second part of the paper, we concentrate on some conceptual difficulties raised by their brilliant attempt to adapt the growing block view of reality to a relativistic setting, based on what they call bow-tie presentism, according to which for each spacetime point s only s plus the spacelike-related region with respect to s exists. By extending temporal logic into a relativity-friendly spatiotemporal logic, we conclude by noting that Correia and Rosenkranz’s Nothing to Come makes very important strides in showing that there are technical ways to develop the growing block of reality into an ontology that coheres with relativity theories perfectly well, while retaining most of the distinctive content of classical growing block theory. During the late nineteenth century, scientists around the world disagreed as to the types of instruments and methods that should be used for determining the most important constant of celestial mechanics: the solar parallax. Venus’s 1874 transit across the sun was seen as the best opportunity for ending decades of debate. However, a mysterious “black drop” that appeared between Venus and the sun and individual differences in observations of the phenomenon brought traditional methods into disrepute. To combat these difficulties, the (...) astronomer Jules Janssen devised a controversial new instrument, the “photographic revolver,” that photographed Venus at regular intervals. Another solution came from physicists, who rivaled the astronomers’ dominance in precision measurements by deducing the solar parallax from physical measurements of the speed of light. Yet other astronomers relied on drawings and well‐trained observers. The new space emerging from this debate was characterized by a decline in faith in photography and in geometry and by the growing realization of the importance of alternative elements needed for establishing scientific truths: power and authority, skill and discipline, standardization, mechanical reproducibility, and theatricality. By examining the “cinematographic turn” in science and its alternatives, this essay brings to light unexplored multidisciplinary connections that contribute to the histories of psychology, philosophy, physics, and film studies. In this paper I present and defend Rovelli's relation quantum mechanics from some foreseeable objections, so as to clarify its philosophical implications vis a vis rival interpretations. In particular I will ask whether RQM presupposes a hidden recourse to both a duality of evolutions and of ontology. I then concentrate on the pluralistic, antimonistic metaphysical consequences of the theory, due to the impossibility of assigning a state to the quantum universe. Finally, in the last section I note interesting consequences of (...) RQM with respect to the possibility of defining a local, quantum relativistic becoming.Given the difficulties of having the cosmic form of becoming that would be appropriate for priority monism, RQM seems to present an important advantage with respect to monistic views, at least insofar as far as the possibility of explaining our experience of time is concerned. In 1877 Peirce distinguished four different methods of “fixating our beliefs”, among which I here concentrate on what could be called the “method of tenacity” and the “method of science”. I then use these distinctions to argue that despite their apparent conflict, pragmatism, relying on the method of tenacity, and naturalism, relying on the method of science, can and should coexist, both in science and in metaphysics.

In this paper I present and critically discuss the main strategies that Bohr used and could have used to fend off the charge that his interpretation does not provide a clear-cut distinction between the classical and the quantum domain. In particular, in the first part of the paper I reassess the main arguments used by Bohr to advocate the indispensability of a classical framework to refer to quantum phenomena. In this respect, by using a distinction coming from an apparently unrelated (...) philosophical corner, we could say that Bohr is not a revisionist philosopher of physics but rather a descriptivist one in the sense of Strawson. I will then go on discussing the nature of the holistic link between classical measurement apparatuses and observed system that he also advocated. The oft-repeated conclusion that Bohr’s interpretation of the quantum formalism is untenable can only be established by giving his arguments as much force as possible, which is what I will try to do in the following by remaining as faithful as possible to his published work. In order to tackle the question posed by the title – notoriously answered in the positive, among others, by Heisenberg, Margenau, Popper and Redhead – I first discuss some attempts at distinguishing dispositional from non-dispositional properties, and then relate the distinction to the formalism of quantum mechanics. Since any answer to the question titling the paper must be interpretation-dependent, I review some of the main interpretations of quantum mechanics in order to argue that the ontology of theories regarding “wave collapse” (...) as a genuine physical process could be interpreted as being irreducibly dispositional. In non-collapse interpretations, on the contrary, the appeal to dispositions is simply a way to reformulate the predictive content of the algorithm of the theory in a fancier metaphysical language. Mauro Dorato charts pressing debates within the philosophy of science that centre around scientific expertise, access to knowledge, consensus, debate, and decision-making. This English-language translation of Disinformazione Scientifica e Democrazia argues that the advancement of science depends on an exponential process of specialization, accompanied by the creation of technical languages that are less and less accessible to the general public. Dorato reveals how such a process must align with representative forms of democracies, in which knowledge and decision-making ought (...) to aim at the society's general interest. Given the importance of the principle of competence, however, the role of experts as mediators of knowledge threatens the citizens' autonomy of choice. Consequently, the risk of technocratic regimes calls for new ways to increase literacy about science and its philosophical and probabilistic foundations. El presente ensayo tiene el propósito de analizar, desde una perspectiva filosófica, los feminicidios ocurridos en Ciudad Juárez, Chihuahua, durante los años noventa y principios de los 2000. Para cumplir tal objetivo, el trabajo se estructura de la siguiente manera: en la primera parte, se enarbolan las tesis fundamentales ofrecidas en los planteamientos de Byung-Chul Han y de Giorgio Agamben, con el propósito de delimitar conceptualmente las nociones de violencia pornográfica, nuda vida y estado de excepción; términos que son retomados (...) en la segunda parte, en la cual se examinan las circunstancias sociales que convirtieron a Juárez en el epicentro de una violencia feminicida sin precedentes en México. La incipiente exhibición pública del cuerpo violentado de forma sexual, que se constituyó como una de las características más notorias de los casos, nos conduce a postular que los feminicidios de Juárez son un ejemplo de la reducción de las mujeres a una vida desnuda que pudo ser arrebatada con absoluta impunidad; transformando a la ciudad chihuahuense en un auténtico estado de excepción. In my review of Steven French's The structure of the world. Metaphysics & Representation. OUP, Oxford, 2014 I argue that the author is forced to navigate between the Scilla of Tegmark’s Pitagoreanism (2008) and the Carybdis of “blobobjectivism” (Horgan and Potrč 2008), namely the claim that the whole physical universe is a single concrete structurally complex but partless cosmos (a “blob”).

Temporal becoming is usually considered the essence of the concept of time. But in our century most physicists and philosophers have defended the view that becoming is dependent on the existence of conscious beings and that there is no ontological difference between past and future. I evaluate these related claims both in light of their conceptual implications and by bringing to bear our best spacetime theories. ;Since a mind-independent becoming should be grounded in an ontological, non-epistemic asymmetry between past and (...) future, I discuss the philosophical motivations for various "non-full views" of the future in contrast to the view that the future is as real as the past. I present the disagreement between these views both in terms of what is and in terms of possession of a definite truth value, thereby distinguishing an ontological and a semantic formulation. A formal definition of the "tree model" of reality allows a clear distinction of the often conflated notions of 'determinate', 'determined' and 'stable', and helps to formulate the differences between the "non-full" views and the "full view" of reality. ;To settle the issue concerning these views, I bring into the discussion the special theory of relativity . I show that oft-discussed arguments against the openness of the future presuppose a clarification of the properties of the relation 'being determinate for', in particular symmetry and transitivity. Within STR, objective becoming can be defended at the cost of relativizing what is determinate to spacetime points, of making the relation of determinedness time-asymmetric, and of denying determinateness to spacelike-related events. ;I conclude by urging that mind-independent temporal becoming can find a more hospitable environment in some isotropic cosmological models of general relativity, a claim that has been unreasonably neglected. If the universe does not present causal anomalies , the proper time of a co-moving 'fundamental particle' can be made common to every other world line. The existence of such a cosmic time would make current scientific talk of 'cosmic evolution' and 'the future of the universe' non-metaphorical. (shrink)

La comedia de Menandro, en particular El Misántropo, hace uso profuso de esta serie de tópicos del humor físico para caracterizar al anciano Cnemón, su personaje central. En varias de sus obras, el slapstick se asocia específicamente al personajetipo del anciano gruñón. El Misántropo retoma claramente el uso punitivo tradicional del recurso, que resulta dominante en (...) la comedia de Aristófanes, en cuanto el slapstick apunta a castigar y transformar la conducta antisocial de Cnemón. No se trata de un recurso asociado al mero entretenimiento, sino que condena a su víctima mediante el escarnio de la agresión y la risa, o bien a su victimario cuando ejerce una violencia descontextualizada, como lo hace el misántropo. The milestone category that is frequently used to refer to the COVID 19 pandemic is called into question to propose that the use of this category is rather what generates a distinction between a past time or a before and a future time or an after. It is proposed that the possibility that this has been erected as a milestone is given by processes that are maintained both globally and locally, even though what allows the appearance of unprecedented events for (...) the Chilean health system is precisely the need to articulate its actions and markedly neoliberal rationalities with global logics. It is specified in the penetration of technological and biopolitical frameworks in the ways of life of the population worldwide and in the notions regarding how to live, and in the colonial matrix of knowledge / power that is at the base of the historical conception of the world system. Experiential imagination consists in an imaginative projection that aims at simulating the experiences one would undergo in different circumstances. It has been traditionally thought to play a role in how we build our lives, engage with other agents, and appreciate art. Although some philosophers have recently expressed doubts over the capacity of experiential imagination to offer insight into the perspective of someone other than our present-selves, experiential imagination remains a much sought-after tool. This paper substantiates pessimism about the epistemological value (...) of these uses of experiential imagination by developing an embodied approach. Our thesis is that experiential imagination is _robustly embodied_ because the _sociohistorically situated_ body makes an irreducible contribution to the imaginative project, and that, as such, it is constrained by who we are as _concrete_ agents. We argue that experiential imagination is an embodied, virtual exploration of imagined scenarios that depends on our situated history of sensorimotor and affective interactions. We conclude that experiential imagination is much more limited than commonly acknowledged, as it can hardly be divorced from who we are and where we have been. (shrink)

ArgumentIn 1895 when the Lumière brothers unveiled their cinematographic camera, many scientists were elated. Scientists hoped that the machine would fulfill a desire that had driven research for nearly half a century: that of capturing the world in its own image. But their elation was surprisingly short-lived, and many researchers quickly distanced themselves from the new medium. The cinematographic camera was soon split into two machines, one for recording and one for projecting, enabling it to further escape from the laboratory. (...) The philosopher Henri Bergson joined scientists, such as Etienne-Jules Marey, who found problems with the new cinematographic order. Those who had worked to make the dream come true found that their efforts had been subverted. This essay focuses on the desire to build a cinematographic camera, with the purpose of elucidating how dreams and reality mix in the development of science and technology. It is about desired machines and their often unexpected results. The interplay between what “is” (the technical), what “ought” (the ethical), and what “could” be (the fantastical) drives scientific research. (shrink)

In this essay I claim that thought experiments have invariably been very important to inquire into the foundations of natural science (in particolar physics). In particular, they have proved essential to test the stability of allegedly clear but ultimately contradictory concepts, that were nonetheless at the basis of widely shared scientific theories. By quickly reviewing some famous Gedankenexperimenten proposed by Einstein against the completeness of (Bohr’s interpretation of) quantum mechanics, I will try to ask how could they possibly have the (...) critical role that they always had.
